Generic Safety, Inc. is committed to inform every American concerning a recent Supreme Court decision, PLIVA, Inc. v. Mensing, 131 S. Ct. 2567 (2011) exempting generic prescription manufacturers from being sued for product liability.
Justice Sotomayor,
dissenting, wrote, "as the majority itself admits, a drug consumer’s right
to compensation for inadequate warnings now turns on the happenstance of
whether her pharmacist filled her prescription with a brand-name drug or a
generic".
According to a report from the IMS, Institute for Healthcare Informatics, 78% of the nearly 4
billion U.S. prescriptions written in 2010 were for generic drugs (both
unbranded and those still sold under a brand name). That means that 3.1 billion prescriptions written in the U.S. annually are not covered by any product liability protection by the manufacturer.
